Conditional Use Permit
Certain land uses, while generally appropriate within a zoning district, may require additional review and approval to ensure compatibility with surrounding development and community standards. In such cases, the Town Commission may grant a Conditional Use Permit (CUP) for a specific use of the property. A CUP is issued for the use itself rather than the individual or business and may be subject to periodic review to ensure ongoing compliance. Conditional Use Permits will only be considered for uses specifically identified as conditional within the Town’s zoning regulations or those determined to be similar in character and intensity.
Application Process: Applicants must submit a completed Conditional Use Permit application form along with the required fee to the Zoning Administrator. Applications are processed in accordance with the Town’s zoning permit procedures. All applications are reviewed by the Planning Board during a public hearing, followed by consideration at a public meeting of the Town Commission. Public notice of the hearing is published in a newspaper of general circulation. If rezoning is required, it may be processed concurrently; however, the Conditional Use Permit will not take effect until rezoning is approved by the Town Commission.
Review and Approval: In evaluating a Conditional Use Permit, the Town Commission must determine that the proposal meets all applicable requirements and checklist criteria established by the Town. Approval may include general and/or special conditions intended to ensure compliance and compatibility with surrounding uses. These conditions run with the land and are binding on current and future property owners. All approved conditions must be recorded with the Madison County Clerk and Recorder prior to the issuance of building permits or commencement of the approved use.
Applications may be approved, conditionally approved, or denied by the Town Commission, and applicants will be notified in writing of the decision. If denied, the determination reflects that the required conditions for approval were not met.
Any future expansion, modification, or change to an approved Conditional Use Permit—including structural changes or extension of use—must undergo the same review and approval process.
